James Smith, beer-seller, of Cable Street, appeared before the magistrates for selling, on the 28th January, a quarter glass of gin, and one of rum.
Mr. F. Armstrong appeared for the information, and Mr. Ascroft for the defendant.
Mr. Elmey, officer in the excise, was the informer in this case, and was cross-examined by Mr. Ascroft, who afterwards called several witnesses whose evidence went against the material testimony of the officer.
The defendant's witness swore distinctly that no rum had been sold to the informant on the day in question; and as the magistrates considered that the evidence for the information had been rebutted, the case was dismissed.
