John Whittingham, beer-seller, of Marsh Lane, appeared before the magistrates for selling, on the 13th February, one pennyworth of tobacco; and a glass of rum on the 29th January.
Mr. Elmey, officer of excise, was the informant.
He swore distinctly to having purchased the tobacco from the defendant, which was sold to him without any hesitation.
The magistrates agreed to examine the premises of Mr. Whittingham, before they would decide upon the case, in consequence of the evidence for the defendant being to the positive effect, that Mr. Elmey had given a wrong description of the locality of the premises.
